1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Everywhere website, applications, and related services (collectively, the “Service”), operated by Everywhere (“Everywhere,” “we,” “us,” or “our”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We may update these Terms from time to time. If we make material changes, we will post the updated version and update the “Date of Last Revision” above. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.

2. Privacy

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and disclose personal data. By using the Service, you acknowledge that you have reviewed our Privacy Policy.

3. Description of the Service

Everywhere is an AI-powered travel discovery and planning platform focused on experiences, tours, and multi-day travel programs.

The Service may allow users to:

  • search and explore travel experiences and destinations;
  • receive AI-assisted recommendations and information;
  • compare travel options and review related content; and
  • access offers, listings, or booking links provided by third-party operators, marketplaces, or travel partners.

Everywhere does not currently operate as the direct provider of all travel products and services displayed through the Service. In many cases, the Service acts as a discovery and referral layer that connects users with third-party providers.

4. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under applicable law. If you are under the age required by applicable law to use the Service on your own, you may use the Service only with the involvement and consent of a parent or legal guardian.

5. Accounts and Registration

Some features may require you to create an account or provide information such as your name, email address, or login credentials.

You agree to:

  • provide accurate, current, and complete information;
  • keep your information updated;
  • maintain the confidentiality of your login credentials; and
  • notify us promptly of any unauthorized use of your account or other security breach.

You are responsible for all activity that occurs under your account, unless such activity results from our own failure to use reasonable security measures.

6. Third-Party Offers, Booking Partners, and Reservations

The Service may display, link to, or provide access to products and services offered by third-party operators, affiliates, marketplaces, or other partners (“Third-Party Partners”).

Unless explicitly stated otherwise, any booking, reservation, purchase, cancellation, modification, refund, or dispute relating to a travel product or service is made directly with the relevant Third-Party Partner, not with Everywhere.

This means:

  • the Third-Party Partner is responsible for the travel service, its availability, pricing, terms, policies, and fulfillment;
  • the Third-Party Partner’s terms and conditions will apply to your booking or purchase; and
  • Everywhere is not responsible for the acts, omissions, errors, cancellations, delays, changes, pricing differences, or service failures of Third-Party Partners.

If you book through a third-party website or platform reached from the Service, you should review that provider’s terms, cancellation rules, refund policy, and privacy practices before completing your reservation.

7. Pricing and Availability

Prices, availability, inclusions, restrictions, and other listing details shown through the Service may be provided by Third-Party Partners and may change at any time without notice.

While we seek to present useful and up-to-date information, we do not guarantee that any listing information, price, availability, tax amount, fee, itinerary detail, or booking condition is complete, current, or error-free.

Final pricing and booking terms will be determined by the applicable Third-Party Partner at the time of booking.

8. AI Features and Informational Nature of the Service

The Service may use artificial intelligence to help generate recommendations, summaries, travel guidance, comparisons, or other outputs.

You acknowledge and agree that:

  • AI-generated responses may be incomplete, inaccurate, outdated, or not suitable for your specific needs;
  • the Service is provided for general informational and discovery purposes;
  • you should independently verify important details, including dates, availability, physical requirements, visa or entry requirements, weather conditions, safety conditions, insurance needs, and cancellation terms; and
  • Everywhere does not guarantee that AI-generated outputs are error-free or fit for any particular purpose.

The Service is not a substitute for professional, legal, medical, financial, insurance, or safety advice.

9. User Content

You may submit, upload, or otherwise provide content through the Service, including text, images, feedback, prompts, itinerary preferences, reviews, or other materials (“User Content”).

You retain ownership of your User Content. However, by submitting User Content through the Service, you grant Everywhere a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, process, and use that User Content solely as necessary to operate, improve, support, and provide the Service, and as otherwise described in our Privacy Policy.

You represent and warrant that:

  • you own or have the necessary rights to provide the User Content;
  • your User Content does not infringe or violate any third-party rights; and
  • your User Content does not violate applicable law or these Terms.

10. Feedback

If you send us ideas, suggestions, or feedback about the Service, you agree that we may use them without restriction or compensation to you.

11. Acceptable Use

You agree not to use the Service to:

  • violate any applicable law or regulation;
  • infringe the intellectual property, privacy, publicity, or other rights of others;
  • upload or transmit malicious code, viruses, or harmful material;
  • interfere with, disrupt, or compromise the security or functionality of the Service;
  • scrape, harvest, copy, or extract data from the Service by automated means unless expressly authorized by us;
  • impersonate any person or entity or misrepresent your affiliation;
  • use the Service to distribute spam, misleading content, or unlawful material; or
  • use the Service to develop or support a competing product using our content, data, or platform in an unauthorized way.

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms.

12. Intellectual Property

The Service, including its design, software, text, graphics, branding, logos, compilations, and other content provided by Everywhere (excluding User Content and third-party content), is owned by or licensed to Everywhere and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, or exploit any part of the Service without our prior written consent.

“Everywhere” and related names, logos, and branding are our trademarks or branding assets, except where otherwise indicated.

13. Third-Party Services

The Service may contain links to third-party websites, tools, maps, services, social login providers, or booking platforms. Your use of those third-party services is governed by their own terms and privacy policies.

We are not responsible for the content, availability, accuracy, or practices of any third-party service.

14. Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

15. Termination

We may suspend or terminate your access to the Service at any time if:

  • you violate these Terms;
  • we are required to do so by law;
  • your use of the Service creates risk for us, other users, or third parties; or
  • we decide to discontinue the Service or a portion of it.

You may stop using the Service at any time.

Upon termination, the rights granted to you under these Terms will end immediately, but provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitation of liability, and governing law.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

EVERYWHERE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS;
  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • ANY INFORMATION, RECOMMENDATION, OR OUTPUT WILL BE ACCURATE, COMPLETE, OR CURRENT; OR
  • ANY THIRD-PARTY PRODUCT OR SERVICE WILL MEET YOUR EXPECTATIONS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERYWHERE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERYWHERE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US, IF ANY, IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Everywhere and its affiliates, officers, directors, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

  • your use of the Service;
  • your User Content;
  • your violation of these Terms; or
  • your violation of any law or third-party rights.

19. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of Chile, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved amicably will be submitted to the competent courts of Chile, unless applicable consumer law provides otherwise.

20. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.

These Terms, together with our Privacy Policy and any additional terms expressly referenced herein, constitute the entire agreement between you and Everywhere regarding the Service.
